सीटेट/एचटेट-2013 मामले में भर्ती में शामिल होने के चांस नहीं के बराबर

• सीटेट/एचटेट-2013 मामले में हाईकोर्ट द्वारा अपने पूर्व के आदेशो को मॉडिफाई कर 23-10-2013 को दिए गये अंतरिम आदेश को पढ़ने के बाद मुझे लगता है कि सीटेट वालो के लिए तो इस जेबीटी भर्ती में शामिल होने के चांस नहीं के बराबर बचे है और एचटेट-2013 वालो के चांस भी कोई ज्यादा अच्छे नजर नहीं आते। हाईकोर्ट के आदेश को पढ़ने से तो यही लगता है कि उन सभी उम्मीदवारो के प्रोविजनल साक्षात्कार लेने है जिन्होंने जेबीटी भर्ती में आवेदन कि लास्ट डेट 08 -12 -2012 तक जेबीटी डिप्लोमा पूरा किया हुआ हो और सिर्फ एचटेट सर्टिफिकेट/योग्यता नहीं रखते हों (सिर्फ वे जिन्होंने एचटेट-2013 में पास किया है)। हाईकोर्ट ने 23-10-2013 को दिए गये अंतरिम आदेश में कहा है कि जेबीटी भर्ती का रिजल्ट घोषित किया जा सकता है परन्तु नियुक्तियाँ देने पर रोक रहेगी। हाईकोर्ट द्वारा 23-10-2013 को दिए अंतरिम आदेश का निर्देश सबंधी पैरा पढ़े--
  
  The foremost questions that arise for consideration in these writ petitions are :
  [i] whether the candidates who have qualified JBT/ETT after 30.07.2011 and were in possession of all other eligibility conditions as on the cut-off date mentioned in the advertisement except the certificate of STET, which they could not obtain as no examination was held after they acquired the
  minimum eligibility, can be deprived of their right to compete?
  
  [ii] Whether the candidates who have qualified CTET during the year 2012 when no STET was held, are entitled to claim eligibility for the advertised posts in terms of guidelines issued by NCTE?
  
  [iii] What would be the fate of candidates who acquired JBT/ETT diploma after 30.07.2011, i.e., the date of advertisement to appear for the STET and who have qualified such tests in the very first opportunity given to them on 26.06.2013 vide the advertisement dated 28.04.2013?
  
  [7]. Since the cases need to be heard elaborately to determine these issues, let the same be listed for further arguments on 09.12.2013.
  
  [8]. Meanwhile, in modification of the order dated 27.08.2013, it is directed that the candidates possessing all other eligibility conditions on the cut-off date as mentioned in the advertisement,except the certificate of STET which they have acquired after the cutoff date shall also be treated eligible, though provisionally. The Board may complete the selection process and declare the result, subject to final outcome of these proceedings. However, the 'Selection Criteria' to be adopted by the Board and the original records of selection shall be produced before us on the date fixed. The Department shall not offer appointments without prior permission of this Court.
