वर्ष 2006 में हरियाणा स्टॉफ सेलेक्सन कमीशन ने स्कूल लेक्चरर कैडर में भर्ती के लिए विज्ञापन संख्या 6/2006 के तहत दिनाक 20 जुलाई 2006 को विज्ञापन जारी किया जिसमे कैटेगरी नंबर 6 के अंतर्गत स्कूल लेक्चरर हिंदी की भर्ती होनी थी। मामले में सुप्रीमकोर्ट ने फैसला दिया कि याचिकाकर्ता का रिकार्ड नष्ट होने के कारण कोर्ट उसको राहत नहीं दे सकता लेकिन इतना जरूर कर सकता है कि सभी लिखित परीक्षा में बैठने वाले अचयनित उम्मीदवारों की कमीशन दोबारा लिखित परीक्षा ले और चयन प्रक्रिया पूरी करके वर्तमान में उपलब्ध स्कूल लेक्चरर हिंदी के पदो पर उनको 4 महीने में नियुक्ति दे। मुझे इस केस में बड़ी रूचि थी और मैं चाहता था की आदेश की पालना हो इसलिए आदेश का पालन न होता देख एक पत्र एक साथी को ड्राफ्ट करके दिया था जो उसने बोर्ड व कमीशन दोनों को भेज दिया था और अब वो भी खुश है कि कम से कम एक चांस तो बना नौकरी का। वो पत्र ये था---

Sub : Regarding compliance of Hon'ble Supreme Court Judgment passed in Civil Appeal no. 4128 of 2012 arising from SLP(C ) No. 31804 of 2010.

Respected Sir,

It is submitted that Haryana Staff Selection Commission (HSSC) advertised the posts of Lecturers in various categories including Lecturers in Hindi vide Advt. No. 6/2006 dated 20-07-2006. Haryana Staff Selection Commission (HSSC) has conducted the written test for the post of Lecturer in Hindi (Education Department) on 15.04.2007 . The result of test was declared on 21.06.2008. I had also participated in the written test of Hindi Lecturer vide Roll No. 05245 on 15.04.2007, but declared unsuccessful in the written test. HSSC had declared the final result on 13.10.2008 after taking interviews of successful candidates.

Thereafter I have come to know that one unselected candidate Poonam Rani @ Poonam challenged the matter regarding the written test and the selection which culminated before the Hon'ble Supreme Court. The Apex Court decided the matter and rendered its judgment on 01-05-2012. The relevant paragraph of the judgment is reproduced below:

"19. The question which remains to be considered is as to what relief, if any, can be given to the appellant. Since the record of selection has been destroyed, it is not possible for this Court to consider and decide the appellant's plea that the assessment of her performance in the written examination was vitiated due to arbitrariness and lack of objectivity. In this scenario, the only possible course could be to direct the Commission to conduct fresh written test and interview. However, it will not be fair to confine the fresh selection to the appellant alone.

The other unsuccessful candidates, who could not approach the High Court or this Court on account of ignorance or financial constraints cannot be deprived of their legitimate right to be again considered along with the appellant and any direction by the Court to consider the case of the appellant alone would result in the violation of the doctrine of equality.

20. In the result, the appeal is allowed and the impugned judgment as also the order passed by the learned Single Judge are set aside. The Commission is directed to hold fresh written test and interview for considering the candidature of the appellant and other unsuccessful candidates after giving them due intimation about the date, time and place of the examination and interview. This exercise should be completed within a period of four months from the date of receipt/production of this order. The candidates who are selected on the basis of the exercise undertaken pursuant to this direction shall become entitled to be appointed against the vacancies which may be available on the date of finalisation of the selection. The parties are left to bear their own costs."

It is very sad to say that 10 months have been passed but no steps have been taken by HSSC to conduct fresh written test. It has come to the knowledge of the undersigned that presently Poonam Rani petitioner in above said matter has been appointed as School lecturer Hindi.

Now, as per Notification dated 31-11-2011, Haryana School Teachers Selection Board is authorized for recruitment of School Lecturer/PGT. So it is kindly requested that Haryana School Teachers Selection Board comply by the judgment of Hon'ble Supreme Court passed in Civil Appeal no. 4128 of 2012 and hold fresh written test for Hindi Lecturer/PGT Hindi pursuant to the judgment.
