PUBLIC NOTICE
The Hon'ble Punjab and Haryana High Court while deciding the Civil Writ Petition
No. 6090 of 2010 titled as Tilak Raj and others V/s State of Haryana on 30.03.2011 has
directed that while it will be open to the State to extend the tenure of the guest teachers,
at all levels, such extensions shall not be beyond 31.03.2012. In fact, on the expiry of the
said date i.e. 31.03.2012, the services of all the guest teachers shall be understood to have
lapsed in terms of the present order and it will not be open for the State to continue any
such guest teacher in service.
In C.W.P. No. 7121 of 2010 titled as Arun Kumar V/s State of Haryana, upon the
asking of Hon'ble High Court, a time frame of 322 days was given by the Department for
recruitment of regular Primary Teachers (PRTs) and 434 days for recruitment of PGT's in
CWP No. 7082 of 2007 titled as Lt. Col. Naresh Ghai, Advocate V/s State of Haryana and
others. The State of Haryana filed SLP (Civil) No. 10818 of 2012 titled as State of Haryana
V/s Tilak Raj and others in the Hon'ble Supreme Court against the order dated
30.03.2011 passed in CWP No. 6090 of 2010 of the Hon'ble High Court. The Hon'ble
Supreme Court while deciding the SLP vide order dated 30.03.2012 has allowed the guest
teachers to continue till the arrival of the regular incumbents as per the schedule
submitted by the Department to function as they have been doing so far.
After the notification and implementation of the Right of Children to Free 86
Compulsory Education Act, 2009 (RTE Act, 2009), there was a reorganization of the
School Education Department, Haryana. The two existing Departments i.e. Primary
Education Department (Class 1 st to 5th) and Secondary Education Department (6th to 12th)
were converted into the Elementary Education Department (Class 1 st to 8th) and the
Secondary Education Department (Class 9 th to 12th) vide Notification No 15/284-2010 Co
(1) dated 22.09.2011. The "Master and C8sV Cadre" of the Secondary. Education
Department who had taught classes 6th to 10th have been held entitled under the RTE Act,
2009 to teach classes 6th to 8th only. As a result of this notification, there was reduction in
number of students and workload and 10357 posts in "Master and C8sV Cadre" were thus
converted into the Post Graduate Teacher Cadre (i.e. PGTs) vide Order No. 4/33-11 SE (4)
dated 14.03.2012. Due to the aforesaid reorganization, the workload of Social Studies
Masters, Mathematics Masters and Hindi Teachers in Government schools decreased and
consequently the guest teachers for these subjects became surplus, as the numbers of
regular TGTs in these subjects are more than the sanctioned posts.
The Hon'ble High Court while hearing CWP No. 2968 of 2015 titled as Seema Devi
Versus State of Haryana and other connected matters has taken cognizance of the above
mentioned directions of the Hon'ble Courts. During the hearing, the State of Haryana
undertook to dispense with the services of the surplus guest teachers, strictly in
accordance with law. Further, the Hon'ble Court has directed that before initiating the
exercise of dispensing the services of these surplus guest teachers, they shall be given
short notice of 24 hours and the State is permitted to serve short/ show cause notice
through vide publication i.e. by causing advertisement in local, regional and national
newspaper.
In compliance of these directions passed by the Hon'ble High Court dated
11.05.2015 in CWP No. 2968 of 2015 titled as Seema Devi Versus State of Haryana and
other connected matters, all the Guest Teachers working as Social Studies Masters,
Mathematics Masters and Hindi Teachers in the Government Schools of the State are
hereby given 24 hours notice to show cause as to why their services should not be
dispensed with. The list containing the names of these guest teachers along with their
present place of posting is available on the websites of the Departments of Elementary
Education/Secondary Education at www.harprathmik.gov.in and
www.schooleducationharyana.gov.in respectively.
6. These guest teachers may submit their representation/reply to this show cause
notice, if any, within the stipulated time period of 24 hours from the date of publication of
this notice to the concerned Head of the School i.e. Principal/Headmaster/Elementary
Head Teacher of the School in which they are posted. In case, any of these guest teachers
fail to submit reply to the Show Cause Notice within 24 hours as directed above, their
services will be deemed to have been dispensed with after expiry of 24 hours from the date
of publication of this notice. In respect of those who submit their replies, orders will be
passed by the concerned Distt. Elementary Education Officer in accordance with law.
