Learned counsel for the petitioners, inter alia, contends that as per the amended Haryana School Education (Group C) State Cadre Service Rules, 2012 (Annexure P-3), essential qualification for appointment to the post of TGT (Punjabi), is BA/B.Ed. The petitioners, who possess the qualification of Giani (Gurmukh Script)/B.A. (Hons. in Punjabi) and L.T.C./O.T. in Punjabi have been rendered ineligible. The petitioners, in the present case, have passed the HTET/STET before 11.04.2012. Hence, as per present advertisement (Annexure P-1), they cannot be rendered ineligible on account of the fact that they have not qualified B.Ed. Learned counsel for the petitioners has referred to a decision given by this Court in Bahadur Singh and another Vs. State of Haryana and others, 2008 (3) PLR 217, whereby for promotion to the post of Headmaster, High School, qualification of O.T. was considered equivalent to B.Ed. Notice of motion. On the asking of the Court, Mr. Keshav Gupta, AAG, Haryana, accepts notice on behalf of the respondent-State and seeks time to get instructions. Copy of this petition be supplied to learned State counsel during the course of the day.Adjourned to 27.08.2016. In the meantime, the respondents shall accept the applications of the petitioners, subject to final decision of this petition.
