)3" //--02.0/1Brief facts of the case are that Sh. Dharambir Baldodia was placed undersuspension vide order dated .15-02-2008 (at CP-1) and chargesheeted under
Sh. Dharambir Baldodia has purchased gas chullahs along with lighter,pipe, regulator and burner © Rs.3297/- each including VAT chargesamounting to Rs.20,44,017/- from The Khadi & Village Industries Board,Faridabad treating it as an approved source whereas it was not approvedsource by the Haryana Government for the said item.
In the open market the value of this set was about Rs.1258/- includingVAT whereas the payment has been made © Rs.3297/- per item. In thisway, he has violated the instructions of the Finance & this Dept and hascaused a loss of Rs.12,64,057/- to the Govt. In addition, the said gaschullahs were not 181 marked.
Thereafter, he replied to the said chargesheet on 17-06-2009 (at CP-29).Finding his reply as unsatisfactory, Sh.
After going through the contents of the charge sheet and explanation thereof,report of regular inquiry officer and written representation, the observations are asunder:-
Regarding charge No. 1, Sh. Dharambir Baldodia, the then BEO Hathin, beingmember of the Committee constituted by the then DEO Mewat, is responsible topurchase an item from The Khadi & Village Industries Board Faridabad, whichwas not an approved source.
By signing the proceedings of placing the order and signing of inspection reportdated 27.04.2007, the said incumbent is responsible for felicitating the paymentof huge amount beyond the actual cost of the articles purchased and iscollectively responsible for causing a loss to the tune of Rs.12,64,057/- bypurchasing the said articles at the rate of Rs.3297/- instead of optimum marketrate of Rs.1258/-.
Taking and overall view of the matter as enunciated above, it has been clearlyestablished beyond an iota of doubt that a loss of Rs.12,64,057/- has been caused tothe state exchequer by Sh. Karan Singh Sehrawat, DEED Mewat, Sh. DharambirBaldodia, BEO Hathin, Sh. Khoob Chand, Head Teacher, GPS Bajarkan (Nuh) and Sh.
Rule 7 ofHaryana Civil Services (Punishment and Appeal) Rules 1987 vide Govt. orderdated 15-07-2008 (at CP-6), on the following charges and allegations:-0. P. Gupta, retired District Judge wasappointed as regulat inquiry officer vide order dated 07.01.2010 (at CP-41) and the saidinquiry officer submitted his report on 23.04.2010 (at CP-103 to 111) proving to someextent all the charges against the said incumbent. In compliance of rule 7(6) of HaryanaCivil Services (Punishment and Appeal) Rules 1987, while agreeing with the said inquiryreport, a communication alongwith a copy of the inquiry report was sent to the saidincumbent to make a written representation within a period of one month, if he sodesired, vide letter dated 16.06.2010 (at CP-112). Accordingly, he had made a writtenrepresentation dated 06.08.2010 (at PUC).Hardial, Head Teacher, GPS Khan) (Nuh). It is specific to mention here that Sh.Dharambir Baldodia, BEO Hathin is also responsible for the said loss being member ofthe committee. Accordingly, punishment of stoppage of two grade increments withcumulative effect is inflicted upon Sh. Dharambir Baldodia, BEO Hathin.
