हरियाणा में शिक्षक भर्ती में न हो विलंब : सुप्रीम कोर्ट

322 दिन में शिक्षक भर्ती प्रक्रिया पूरी न होने पर सुप्रीम कोर्ट ने अवमानना याचिका का निपटारा करते हुए हाईकोर्ट को निर्देश दिया है कि वो शिक्षक भर्ती से संबंधित मामलों में जल्दी फैसला दे, ताकि भर्ती में और विलंब न हो। साथ ही कोर्ट ने विभाग को भी तेजी से नियुक्तियां देने का निर्देश दिया है।1शिक्षक भर्ती में सरकार के रवैये से खफा होकर पात्र अध्यापक संघ ने 2012 में अवमानना याचिका दाखिलकर दी। आरोप लगाया कि सरकार अतिथि अध्यापकों को बनाए रखने के फेर में जान-बूझकर भर्ती मेंधीरे-धीरे कदम उठा रही है। सुप्रीम कोर्ट ने सबंधित पक्षों से जवाब व भर्ती की स्टेटस रिपोर्ट दाखिल करने को कहा था। इस पर सभी पक्षों ने अपना जवाब सुप्रीम कोर्ट में दाखिल किया और भर्ती में देरी का कारण हाईकोर्ट में स्टे लगने व लंबित मामलों को बताया।

सुप्रीम कोर्ट के 26-03-2014 के ताजा निर्देश/आदेश से अब जेबीटी+पीजीटी के 3 विषयों से सबंधित मामले तेजी से निपटेगे और भर्ती तेजी से संपन्न होगी तथा जॉइनिंग का इंतजार कर रहे पीजीटी हिंदी के शेष चयनित उम्मीदवारों को भी जल्दी नियुक्ति मिलेगी।
कुछ लोगों ने ये झूठी अफवाह ऊड़ा रखी है कि जेबीटी भर्ती को 322 दिन में पूरी करने से सबंधित सुप्रीम कोर्ट में चल रहा अवमानना केस ख़ारिज हो गया है। जबकि सही बात तो ये है कि वो केस ख़ारिज नहीं हुआ बल्कि सुप्रीम कोर्ट ने हमारे हक में आदेश पारित करते हुए याचिका का निपटारा करते हुए कहा है कि हाई कोर्ट में स्टे/लंबित मामलो के चलते भर्ती तय समय पर पूरी करने में अड़चने आई है और हमारे निवेदन पर अब सुप्रीम कोर्ट ने हाईकोर्ट को ये आदेश दिया है कि वो भर्ती से सबंधित सभी लंबित केसों में जल्दी से जल्दी फैसला दे ताकि भर्ती अब और ज्यादा लेट न हो। ये आदेश भी दिया है कि हाईकोर्ट से फैसले आते ही रिजल्ट घोषित हो व सबंधित विभाग तेजी से नियुक्तियाँ दे जैसा कि सुप्रीम कोर्ट ने 30-03-2012 आदेश पारित किया था। यही आदेश हम सुप्रीम कोर्ट से चाहते थे ताकि हाईकोर्ट में लंबित मामले जल्दी से निपटे और अब पूरी उम्मीद है कि सुप्रीम कोर्ट के निर्देशों के कारण 23 अप्रैल को जेबीटी वाले (सीटेट+एचटेट-2013 केस) मामले में हाईकोर्ट अपना अंतिम फैसला दे देगा और सभी क़ानूनी अड़चन दूर हो जायेगी। मामले में हाईकोर्ट का फैसला आते ही रिजल्ट घोषित करना पड़ेगा और विभाग को तेजी से जॉइनिंग भी देनी पड़ेगी क्योकि ये सुप्रीम कोर्ट के ताजा आदेश है। सुप्रीम कोर्ट का ये ताजा आदेश सभी साथिओं के सहयोग व लगातार प्रयासो से मिली बड़ी जीत है।---पवन चमारखेड़ा,पात्र अध्यापक संघ,94666-11718

UPON hearing counsel the Court made the following
O R D E R
We have heard learned counsel for the parties at length.Without mentioning the factual background in detail,suffice it is to state that the State of Haryana has appointed 'Guest Teachers' without following regular recruitment procedure and these teachers have been allowed to continue. Their appointment and continuation became the subject matter of certain proceedings which landed in this Court as well.
In those matters, order dated 30th March, 2012 was passed with the following directions:
"7. Having heard the learned Attorney General for
India, Mr. Subramanium and Mr. Vishwanathan, learned senior
advocates, for the parties and also keeping in mind the
submissions made by Mr. Vishwanathan, that the intention of
the Division Bench of the High Court was that no further
appointments of 'Guest Teachers' should be made after 1st
April, 2012, and that the vacancies should be filled up by
posting and reposting teachers in the different
institutions, we feel that the two things should really be
kept separate, notwithstanding the apprehension voiced by
Mr. Vishwanathan, that this could lead to continuance of
appointment of 'Guest Teachers'.
8. We make it very clear that as directed by the
Division Bench of the High Court, no fresh appointments of
'Guest Teachers' will be made from 1st April, 2012.
However, since students also cannot be made to suffer on
account of the delay in the appointment of regular
teachers, we direct that the exercise indicated in the
scheme, must be completed within the time specified in the
scheme and no further extension or deviation therefrom will
be permitted.
9. Till then, the 'Guest Teachers' may be allowed to
continue to function, as they have been doing so far."
It is the violation of the aforesaid directions, which is
alleged by the petitioner in the present Contempt Petition. It
is his plea that in spite of direction given in the aforesaid order dated 30th March, 2012 to the State of Haryana to make
appointments of teachers on regular basis, the State through its
officers who are arrayed as respondents/contemnors in the
present petition are dilli dallying the matter with sole
intention to continue with the engagement of 'Guest Teachers' in
the meantime.
It is further argued that it has happened even when
specific direction was given that exercise for appointment of
regular teachers shall be completed as indicated in the Scheme
and no further extension or deviation would be permitted.
The matter came up from time to time for hearing. The
Haryana School Teachers Selection Board (hereinafter referred to
as "the Board") is the authority which has to undertake the
process of making selections and on the recommendation of the
Board, Government is to make the appointments.
Though some officers of Haryana State Public Service
Commission have also been impleaded as contemnors, it is
accepted at the bar that the Haryana State Public Service
Commission has no role in making selections of the school
teachers.The Chairman and Secretary of the Board are arrayed as
contemnors Nos. 8 and 9. An additional affidavit dated 6th
February, 2014 is filed on behalf of these respondents Nos. 8
and 9. In this affidavit, it is explained that insofar as the
Board is concerned, it has already undertaken and completed the
selection process. However, the respondents are not able to
make the appointment on the basis of the selection made by the
Board in view of stay order granted by the High Court of Punjab
& Haryana on 23rd October, 2013 in some writ petitions pending
before it.
Having regard to the aforesaid facts, we are of the
opinion that no further orders/directions are required to be
passed in the matter, except clarifying that the appointments of
the candidates, which are stated to have been already selected
by the Board, shall be made once the embargo contained in the
High Court's order dated 23rd October, 2013 is lifted. We
impress upon and request the High Court to decide the said writ
petitions as expeditiously as possible.
We further make it clear that all future selection shall
be made in accordance with the Scheme indicated in the affidavit
dated 19th March, 2012 of Surina Rajan, Financial Commissioner &
Principal Secretary to Government of Haryana, School Education
Department, Chandigarh filed in C.W.P. No.7121 of 2010 before
the High Court.
The contempt petition is disposed of in the above terms.
