High Court Update: हरियाणा में HTET बीएड पास कैंडिडेट JBT के लिए होगा मान्य

Yesterday, ie. 09.12.2020 while issuing notice of motion, this
Court passed the following order:
"Inter alia contends that in view of Clause-in of Notifications Dated 21.07.2011 (P-8) the respondents are bound to follow the NCTE guidelines for conducting the Haryana Teachers Eligibility Test (HTET) scheduled to be held on 02/03.01.2021
Notice of motion for 10.12.2020. Notice re: interim relief also.
Mr. Tanisha Peshwaria, DAG, Haryana accepts notice on behalf of the respondents and seeks time to have instructions in the matter."
Today, it is contended on behalf of the petitioners that they are post-graduate along with Bachelor degree of Education (B.Ed.), but not being considered eligible to apply for ensuing HTET (PRT) on the premise that petitioners are not having two years Diploma in Elementary Education. Further contended that in view of the notification dated 28.06.2018 (P-2) issued by the National Council for Teacher Education (NCTE)-respondent No.3, a graduate with at least 50% marks along with B.Ed. is eligible for the post of PRT, thus, all the petitioners are duly eligible and reference, in this regard is made to clauses 1 and 2 of the notification referred above, which read as under
"() In the said notification, in para 1 in sub-para (1), in clause (a) after the words brackets "Graduation and two year Diploma in Elementary Education (by whatever name known), the following shall be inserted, namely
OR "Graduation with at least 50% marks and Bachelor of
Education (B.Ed.)"
2. In the said notification in para 3. for sub-para(d), the following sub-para shall be substituted namely:

(a) who has acquired the qualification of Bachelor of Education from any NCTE recognized institution shall be considered for appointment as a teacher in classes I to V provided the person so appointed as a teacher shall mandatorily undergo a six month Bridge Course in Elementary Education recognized by the NCTE within two years such appointme as primary teacher
Faced with the above situation, learned counsel for the respondents seek time to have instructions and/or file reply in the matter. On their request, adjourned to 06,01.2021.
Since in view of the provisions of sub-section 1 of Section 23 of Right of Children to Free and Compulsory Act, 2009 (Act of 2009), respondents cannot ignore the minimum qualification prescribed by NCTE for recruitment of teacher(s), including PRT: therefore, in the meanwhile. respondent No.4 will treat all the petitioners eligible for the ensuing HTET (PRT) as well, but the same shall be subject to the final outcome of the writ
petition and their result be not declared without permission of this Court. It is clarified that this order will not confer any equitable rights
in favour of the petitioners
