All female Govt. employees can avail of 6-month maternity leave with salary.DDO of female employees can allow maternity leave to employees after a CMO medical certificate. After getting a CMO medical certificate female employees can apply at any time for six months of maternity leave. CMO makes a medical certificate on behalf of DDO letter.

Maternity leave for 3rd child


Third child maternity leaves- Haryana Govt. allow maternity leave for 3rd child to women employee vide finance department letter no. 11/16/89-3FR-II dated 20.05.2016. The court case regarding third child maternity leave was supreme court case Javed and others vs State of Haryana and others (2003)8SCC 369 and Air India and others vs Nergesh Meerza and others (1981) 4SCC335. The high court allowed CWP No. 4229 of 2011 Ruksana vs. the State of Haryana by holding the petitioner is entitled to the payment of salary as maternity leave benefit as envisaged under section 5 of the maternity benefit read with rule 8.124 of Punjab CSR volume I part I without making any reference to note 4 appended thereunder.

Maternity leave for 3rd child 


The power delegated to District education officer for Third child maternity leave by Director Pk Dass on dated 30.08.2016

Haryana Govt extended the benefit of judgment cwp no. 4229 of 2011 to all women employee of the Haryana Government. The draft rules are awaiting legal vetting by the legal remembrance and secretary to Govt. of Haryana, Law and legislative department.
