This order will dispose of CWP Nos. 19747, 19909, 19978, 20104, 24903 and 24921 of 2014, as the issue involved in all the petitions
is common.
Affidavit of M. L. Kaushik, Director, Secondary Education, Haryana, Panchkula dated 20.3.2016 filed today in court in CWP No. 19747
of 2014, is taken on record. In the affidavit, it has been stated that the clause in the advertisement requiring “consistent good academic record”, to which the petitioners have grievance has been substituted with a new provision defining the term as “good academic record”.

With the change in the conditions laid down in the advertisement for recruitment to the post of TGT and the State having withdrawn the earlier advertisement requiring “consistent good academic record” and having issued a fresh advertisement substituting “good

academic record” on 28.6.2015, in pursuance to which the petitioners have also applied and the process for selection is in progress, learned counsel for the petitioners submitted that the prayer made in the present set of petitions has been rendered infructuous and the same may be disposed of as such.

Ordered accordingly.

Learned Advocate General, Haryana, states that since the
election process is in operation, therefore, four weeks further time is required to take decision with regard to the nomenclature of “Consistent Good Academic Record” for the posts advertised vide advertisement dated 30.08.2014 (Annexure P-5). He requests for an adjournment for one month.

In view of the request made by learned Advocate General, Haryana, this petition is adjourned to October 27, 2014, and the Haryana School Teachers Selection Board (respondent No.2 herein) is directed to accept the application forms submitted manually by the petitioners or any other candidate having not consistent good academic record, i.e. on account of having secured less than 45% marks in Matriculation examination, and
wishing to apply for the posts in pursuance of the aforesaid advertisement, subject to the decision of this writ petition. Respondent No.2 is further directed to issue an advertisement in this regard, in a news paper, being circulated in the region.

Copy of this order be issued to the office of the Advocate General, Haryana, under the signatures of the Bench Secretary.

हूड्डा सरकार के समय में HSTSB ने 30-8-2014 को शिक्षकों की भर्ती के लिए विज्ञापन दिया था जिसमें Good Academic Record की शर्त थी जिसको कई उम्मीदवारों ने इसे हाईकोर्ट में चुनौती दी l

हरियाणा में BJP की सरकार बनते ही HSTSB को भंग कर दिया था l

शिक्षा विभाग के निदेशक ने 15-12-2014 को हाईकोर्ट में एक पत्र दिया जिसमें लिखा था कि 25-11-2014 को हरियाणा सरकार ने फैंसला लिया है और HSTSB से बकाया सारी भर्ती वापिस लेकर HSSC (हरियाणा कर्मचारी चयन आयोग) को दे दी हैं l इसलिए अब इस बारे में हरियाणा सरकार से निर्देश का इंतजार है जिसके लिए समय चाहिए l

HSSC की PGT की जो भर्ती है जिसकी अब आवेदन करने की आखिरी तारीख 12 अक्टूबर है, शायद ये सब केस इसी भर्ती के खिलाफ हैं l

अब शायद इन केसों की अगली सुनवाई 8-12-2015 को होगी l सही जानकारी तो याचिकाकर्ता ही दे सकते हैं l

मेरी जानकारी के अनुसार Good Academic Record के खिलाफ जो केस डले हुए हैं वे निम्न प्रकार हैं :-

CWP Nos. 19747, 19909, 19978, 20104, 20195, 20254, 20263, 24903, 24921 of 2014, CWPs No. 20411 of 2014

नोट :- मैं सिर्फ information share कर रहा हूँ l इन केसों के पीछे मेरी कोई मनसा नही है l कुछ ना समझ लोग समझ लेते हैं कि सब केस मैंने ही करवाए हैं l
