Whereas Smt, Usha Rani the then Principal, Govt. Sr. Sec. School, Hansi (Hisar)

now Deputy District Education Officer, Hisar was charge sheeted under rule-7 of

Haryana Civil Services (P&A) Rule 1987 vide order No. 5/76-05 HRG-I (1) dated 27 08 08,

where in the following charges were leveled against her:-

Bogus Experience Certificate from 05.10.81 to 30.09.83 pertaining to Head

Mistress St. Peter High School, Hansi (Hisar) while applying for the post of

Principal in 1996.

Violation of the transfer orders.

Whereas Smt, Usha Rani submitted her reply dated 29.06.09 to the said charge

sheet and refuted all the charges levelled against her. Since reply of Smt, Usha Rani was

not found satisfactory, therefore, Sh. I.M. Khungar, IAS (Retd) was appointed as Inquiry

Officer. The Inquiry Officer vide his report 15.12.09 exonerated her regarding charge No.1

and proved the second charge. A Show Cause Notice dated 02.08.10 was issued for

inflicting a punishment of termination from service. After receipt of her reply dated

24.08.10 she was heard in person on 01.12.10. At that time, the case was examined

again in detail in the light of provisions of Haryana Civil Service (Punishment and Appeal)

Rules, 1987 and it was observed, that the regular Inquiry Officer has failed to take notice

of the patent error existing in the experience certificate as Head Mistress of St. Peter High

School, Hansi (Hisar) from 05.10.81 to 30.09.83. As per amended Rule 7(6) of the

Haryana Civil Services (Punishment and Appeal) Rules, 1987 issued vide notification

dated 06.07.07, the disciplinary authority is required to supply a copy of the regular

enquiry report and where the disciplinary authority does not agree with the enquiry

report or part thereof, the reasons for such disagreement are required to be

communicated along with the enquiry report to the delinquent employee so that he can

send a representation, if he so desires, to the disciplinary authority within a period of one

month from the date of such communication. Accordingly, a dissenting note dated

30.12.10 was sent to her. She submitted her reply on 14.02.11 to the dissenting note.

I have gone through the entire record of the case i.e. Committee report dated

03.10.05, DEO Hisar report dated 04.10.05, fact finding inquiry report dated 07.10.05

and 10 08 07 submitted by Sh. Lalit Siwatch, HCS, Joint Director and Sh. M.L. Kaushik,

HCS, Addl. Director, respectively, charge-sheet under Rule-7 and explanation thereof,

regular Inquiry Officer report dated 15.12.09, Show Cause Notice dated 02.08.10,

dissenting note dated 30.12.10 and reply thereof. The main question to be decided in this

case is whether the incumbent fulfills the condition of experience of 2 years as head of

the Institution while applying for the post of Principal in 1996 and whether the said

experience certificate is genuine.

From the perusal of experience certificate dated 14.05.84 pertaining to St. Peter

High School, Hansi (Hisar), the same has been countersigned by Sub-Divisional

Education Officer (SDEO) on 16.07.96 i.e. after a lapse of more the 12 years and in the

experience certificate it is clearly mentioned that the school is recognized whereas as per

DEO report dated 04.10.05 that during the period from 05.10.81 to 30.09.83 the school

was upto middle standard only and Smt. Usha Rani has never worked in the said

institution in any capacity and has concluded that the experience certificate was fake

and bogus. This view has been confirmed by a 6-Member Committee constituted by the

then Joint Director (Administration). Denial of issuance of the said experience certificate

by Sh. P.L. Ahuja, the then Principal, St. Peter Sr. Sec. School, Hansi (Hisar) duly

supported by Affidavit before the said Committee, further endorse the said version. The

finding of inquiry conducted by Sh. M.L. Kaushik as enunciated above clearly establish

that the school was not recognized at all during the relevant period and the delinquent

official has not worked in the said institution at all in any capacity. The said incumbent

in her latest explanation dated 14.02.11 herself have admitted that the said institution

was not recognized. It is highly surprising how the regular Inquiry Officer of the level of

Senior IAS (Retd.) has tried to circumvent the patent error in the experience certificate

especially regarding recognized institution. It is beyond doubt that the said institution

was not recognized upto high school level during the relevant period. So far as second

arge is concerned, it stood approved by the regular Inquiry Officer and there is no

dispute regarding this It is specific to mention here that an FIR No. 74 dated 15.02.06

was also got registered in this case and is beyond understanding how Smt. Santosh

Kumari, the then DEO Hisar had given her Consent statement dated 16.05.08 before the

Court in a cancellation report submitted by Police without approval of the competent

authority. Vide order dated 16.05.08 FIR was cancelled and the case was filed. The

observation of the incumbent regarding reviewing the orders is of no consequence as the

matter regarding inflicting final punishment was still pending.

In the light of above, both the charges stood approved against Smt. Usha Rani,

Deputy DEO, Hisar. She has been selected Principal in direct quota on the basis of fake,

bogus and non-genuine experience certificate of St. Peter High School, Hansi (Hisar).

टल सकती हैं हरियाणा शिक्षा बोर्ड की परीक्षाएं

भिवानी . हिसार लोकसभा सीट पर हो रहे उपचुनाव के कारण हरियाणा विद्यालय शिक्षा बोर्ड की सेकंडरी और सीनियर सेकंडरी के प्रथम सेमेस्टर की परीक्षाओं की तिथि आगे बढ़ सकती है। हालांकि बोर्ड प्रशासन ने इस बारे में अभी तक अधिकारिक तौर पर कोई घोषणा नहीं की है लेकिन परीक्षाओं का टलना लगभग तय माना जा रहा है।

परीक्षाओं की तिथि आगे बढ़ाने के लिए सरकार का नोटिफिकेशन आता है और अब बोर्ड को उसका इंतजार है। इससे पहले सूचना दी गई थी कि हरियाणा विद्यालय शिक्षा बोर्ड की सेकंडरी व सीनियर सेकंडरी (नियमित) की प्रथम सेमेस्टर की परीक्षाएं 30 सितंबर से शुरू होनी थी। साथ ही सेकंडरी और सीनियर सेकंडरी (रि-अपीयर), ओपन स्कूल की सेकंडरी और सीनियर सेकंडरी की रि-अपीयर और डीएड द्वितीय सेमेस्टर, डीएड प्रथम सेमेस्टर की रि-अपीयर, डीएड पार्ट एक व दो(ओल्ड) की फेल व कंपार्टमेंट परीक्षार्थियों की परीक्षाएं भी होंगी।

अब ये परीक्षाएं 14 अक्टूबर के बाद हो सकती हैं। बोर्ड के सचिव शेखर विद्यार्थी ने कहा कि बोर्ड की परीक्षाएं आगे बढ़ाने के संबंध में अभी कोई नोटिफिकेशन जारी नहीं हुआ है। लेकिन संभावना है कि उपचुनाव के कारण परीक्षाओं की तिथि आगे बढ़ाई जा सकती हैं। जब नोटिफिकेशन होगा तभी हम आधिकारिक तौर पर इसकी घोषणा कर सकते हैं।

बोर्ड ने दिया गलती सुधारने का मौका

हरियाणा अध्यापक पात्रता परीक्षा के जो आवेदक आवेदन पत्र पर अपना फोटो लगाना भूल गए थे उन्हें गलती सुधारने का मौका मिल गया है। इस तरह जिन आवेदकों को सामान्य श्रेणी के लिए अप्लाई करना था, लेकिन उन्होंने गलती से आरक्षित वर्ग की कीमत वाले आवेदन पत्र को भरकर भेज दिया था वे भी अपनी गलती दुरुस्त कर सकते हैं। बोर्ड ने ऐसे आवेदकों की सूची अपनी वेबसाइट पर जारी कर दी है। अब ऐसे आवेदक 16 सितंबर तक बोर्ड मुख्यालय में उपस्थ्ति होकर इन गलतियों को ठीक करवा सकते हैं।

जिन आवेदकों ने अपने फोटो नहीं लगाए, वे निर्धारित तिथि तक अपने फोटो बोर्ड को उपलब्ध करा दें। इसके अलावा जिन आवेदकों ने गलती से सामान्य श्रेणी की जगह आरक्षित वर्ग की कीमत वाला आवेदन पत्र भर दिया, ऐसे आवेदक बकाया राशि 300 रुपए बोर्ड कार्यालय में आकर जमा करवा दें और बोर्ड की तरफ से नो ड्यूज स्लिप को बोर्ड की विशेष परीक्षा शाखा में जमा करवाएं। यदि आवेदक भुगतान राशि स्लिप को जमा नहीं करवाता है तो उसे अनुक्रमांक जारी नहीं किया जाएगा। इससे पहले भी बोर्ड ने आवेदकों को गलतियां ठीक करवाने का मौका दिया था, जिसके बाद 6200 के करीब आवेदकों ने अपनी गलतियां ठीक करवाई थीं।

टेट के 2.50 लाख प्रमाण-पत्र अटके

हाईकोर्ट ने 60 प्रतिशत से कम अंक वाले आरक्षित वर्ग के अभ्यर्थियों को पास न करने के निर्देश दिए
जयपुर।शिक्षक पात्रता के लिए हाल ही हुई टेट के करीब 2.50 प्रमाण-पत्र अब अटक गए हैं। हाईकोर्ट के टेट में 60 प्रतिशत से कम अंक लाने वाले आरक्षित वर्ग के अभ्यर्थी के संबंध में दिए गए दिशा-निर्देशों के बाद राजस्थान माध्यमिक शिक्षा बोर्ड ने फिलहाल इन प्रमाण-पत्रों रिलीज करने पर रोक लगा दी है। हाईकोर्ट ने शुक्रवार को एक महत्वपूर्ण फैसले में 60 प्रतिशत से कम अंकों वाले किसी भी वर्ग के अभ्यर्थियों को उत्तीर्ण करने पर रोक लगा दी थी।
परीक्षा की नोडल एजेंसी माध्यमिक शिक्षा बोर्ड के सचिव मिरजू राम शर्मा ने बताया कि टेट उत्तीर्ण करने वाले करीब ढाई लाख छात्रों के प्रमाण-पत्र तैयार करवाए जाने की प्रक्रिया जारी हैं। बोर्ड जल्द ही प्रमाण-पत्रों को रिलीज करने वाला था, लेकिन फिलहाल कोर्ट के निर्देशों के तहत इसे रोक दिया गया है।

शर्मा ने बताया कि अब प्रमाण-पत्रों को रिलीज करने की कार्यवाही कानूनी प्रक्रिया पूरी होने के बाद ही हो सकेगी। इस परीक्षा को उत्तीर्ण करने के बाद ही छात्र थर्ड ग्रेड शिक्षक बनने के योग्य हो सकेगा। इधर शिक्षा विभाग के अधिकारियों के अनुसार प्रमाण-पत्र रिलीज होने पर लगी रोक के कारण अब थर्ड ग्रेड भर्ती परीक्षा आयोजित करने की तैयारी भी प्रभावित हो सकती है।
बीएसटीसी की दूसरी काउंसलिंग से इनकार
राज्य सरकार ने बीएसटीसी की दूसरी काउंसलिंग कराने से साफ इनकार कर दिया है। बीएसटीसी के लिए शुक्रवार को हुए अंतिम प्रवेश के बाद करीब डेढ़ हजार सीटें खाली रहने की संभावना है। खाली रही सीटों का विस्तृत ब्यौरा प्रवेश समिति सोमवार को जारी करेगी। इधर खाली सीटें रहने के बावजूद छात्रों को प्रवेश नहीं मिलने से प्रदेशभर में बीएसटीसी छात्रों में असंतोष है।
राज्य में बीएसटीसी की 13650 सीटों के लिए हुई काउंसलिंग के लिए करीब 65 हजार छात्रों का रजिस्ट्रेशन हुआ था। पहले दौर की काउंसलिंग में जिन छात्रों ने फीस नहीं जमा कराई थी, उनकी फीस जमा कराने की अंतिम तिथि 9 सितंबर तय करते हुए छात्रों को ऑप्शन दिया गया था। इस ऑप्शन के तहत करीब 550 छात्रों ने फीस जमा कराई।

बीएसटीसी प्रवेश समिति के संयोजक एम.एल. अग्रवाल का कहना है कि बीएसटीसी में इस बार करीब डेढ़ हजार सीटें खाली रहने की संभावना है। संस्थानवार इसकी सूची सोमवार तक तैयार कर ली जाएगी। अग्रवाल ने बताया कि अब दूसरे दौर की काउंसलिंग के लिए सरकार ने इनकार कर दिया है, ऐसे में ये सीटें मौजूदा सत्र में खाली ही रहेंगी। उल्लेखनीय है कि इस बार बीएड में भी दूसरे दौर की काउंसलिंग नहीं होने से करीब साढ़े सात हजार सीटें खाली रह गई हैं।

टेट में 60% से कम तो आरक्षित वर्ग के अभ्यर्थी को न करें पास : हाईकोर्ट

जयपुर.राजस्थान उच्च न्यायालय ने आरक्षित वर्ग (एससी, एसटी, ओबीसी व महिला) को 60 प्रतिशत से कम अंक लाने पर टेट उत्तीर्ण करने के प्रमाण पत्र जारी करने पर 16 सितंबर तक रोक लगा दी है।

न्यायाधीश एन.के जैन (प्रथम) ने सरकार को भी कारण बताओ नोटिस जारी किया है। इसमें पूछा गया है कि आरक्षित वर्ग को दोहरा लाभ किस आधार पर दिया गया? कोर्ट ने यह आदेश दुर्गादास व अन्य की याचिकाओं पर दिया। याचिका में टेट परीक्षा में आरक्षित वर्ग को दोहरा लाभ देने को चुनौती दी गई है।

इस तरह मिल रहा है दोहरा लाभ

याचिकाकर्ताओं के वकील विज्ञान शाह ने अदालत को बताया कि टेट परीक्षा में शामिल होने के लिए पात्रता न्यूनतम 50 प्रतिशत के साथ स्नातक और बीएड होना रखी गई थी। यह सभी वर्गो के अभ्यर्थियों पर लागू थी।

बाद में आरक्षित वर्ग को पात्रता में 5 प्रतिशत की छूट दे दी गई, जिससे आरक्षित के अभ्यर्थियों के लिए न्यूनतम पात्रता 45 प्रतिशत हो गई। सरकार ने टेट में सामान्य वर्ग के लिए परीक्षा उत्तीर्ण करने के न्यूनतम प्राप्तांक 60 प्रतिशत निर्धारित किए, जबकि आरक्षित वर्ग के लिए फिर इसमें 10 प्रतिशत की छूट देकर न्यूनतम प्राप्तांक 50 प्रतिशत कर दिए।

याचिकाकर्ता का कहना था कि आरक्षित वर्ग को दोहरा लाभ नहीं दिया जा सकता। उन्हें एक स्तर पर ही छूट दी जा सकती है।

अब क्या होगा?

टेट परीक्षा में आरक्षित वर्ग को 60 प्रतिशत से कम अंक लाने पर अभी तक अस्थायी प्रमाण पत्र जारी किए जा रहे थे। कोर्ट के आदेश के बाद ये प्रमाण पत्र जारी नहीं किए जा सकेंगे।

आंध्र की तर्ज पर पदोन्नत होंगे स्कूल प्राध्यापक

चंडीगढ़, जागरण ब्यूरो : प्रदेश में स्कूल लेक्चररों की पदोन्नति आंध्रप्रदेश के तर्ज पर होगी। शिक्षा मंत्री गीता भुक्कल ने हरियाणा स्कूल लेक्चरर्स एसोसिएशन (हसला) के प्रतिनिधिमंडल से बातचीत के दौरान यह जानकारी दी। हसला के प्रदेश अध्यक्ष किताब सिंह मोर और महासचिव दलबीर सिंह पंघाल के नेतृत्व में प्रतिनिधिमंडल बृहस्पतिवार शाम भुक्कल से मिला था। शिक्षक नेताओं की मांग पर शिक्षामंत्री ने निदेशक को निर्देश दिया कि जो प्राध्यापक आरोही स्कूलों में प्रति नियुक्ति पर भेजे गए हैं, उन्हें उनके पुराने स्कूलों में भी तीन-तीन दिन भेजा जाए। मंत्री ने आरोही स्कूलों में शीघ्र नई नियुक्तियां करने का भरोसा दिलाया और कहा कि इन नियुक्तियों के बाद प्रतिनियुक्ति पर भेजे गए लेक्चररों को वापस उनके पुराने स्कूलों में भेज दिया जाएगा। शिक्षा मंत्री ने कहा कि प्राध्यापकों की वेतन विसंगतियां 4800 ग्रेड पे के स्थान पर 5400 ग्रेड पे करने के लिए वित्त विभाग को केस बनाकर भेजा जाएगा। किताब सिंह मोर ने स्कूल प्राध्यापकों की वरिष्ठता सूची शीघ्र जारी करने व पदोन्नति के लंबित मामले के शीघ्र निस्तारण की मांग की है। उन्होंने कहा कि जिन स्कूलों में वेतन का बजट अभी नहीं पहुंचा है, वहां इसे तुरंत निर्गत कराया जाए ताकि शिक्षकों व कर्मचारियों को परेशानी न उठानी पड़े। शिक्षा मंत्री ने एलटीसी की राशि जल्द जारी कराने का भरोसा भी दिलाया। प्रतिनिधिमंडल में प्रांतीय वरिष्ठ उप प्रधान रामफल सहरावत, हसला हिसार के जिला प्रधान महीपाल पूनिया, जींद के प्रधान मुकेश नैन प्रमुख रूप से शामिल रहे।
