Order No. 5/76-2005 HRG-I (1) Dated, Chandigarh the
Whereas Smt, Usha Rani the then Principal, Govt. Sr. Sec. School, Hansi (Hisar)
now Deputy District Education Officer, Hisar was charge sheeted under rule-7 of
Haryana Civil Services (P&A) Rule 1987 vide order No. 5/76-05 HRG-I (1) dated 27 08 08,
where in the following charges were leveled against her:-
Bogus Experience Certificate from 05.10.81 to 30.09.83 pertaining to Head
Mistress St. Peter High School, Hansi (Hisar) while applying for the post of
Principal in 1996.
Violation of the transfer orders.
Whereas Smt, Usha Rani submitted her reply dated 29.06.09 to the said charge
sheet and refuted all the charges levelled against her. Since reply of Smt, Usha Rani was
not found satisfactory, therefore, Sh. I.M. Khungar, IAS (Retd) was appointed as Inquiry
Officer. The Inquiry Officer vide his report 15.12.09 exonerated her regarding charge No.1
and proved the second charge. A Show Cause Notice dated 02.08.10 was issued for
inflicting a punishment of termination from service. After receipt of her reply dated
24.08.10 she was heard in person on 01.12.10. At that time, the case was examined
again in detail in the light of provisions of Haryana Civil Service (Punishment and Appeal)
Rules, 1987 and it was observed, that the regular Inquiry Officer has failed to take notice
of the patent error existing in the experience certificate as Head Mistress of St. Peter High
School, Hansi (Hisar) from 05.10.81 to 30.09.83. As per amended Rule 7(6) of the
Haryana Civil Services (Punishment and Appeal) Rules, 1987 issued vide notification
dated 06.07.07, the disciplinary authority is required to supply a copy of the regular
enquiry report and where the disciplinary authority does not agree with the enquiry
report or part thereof, the reasons for such disagreement are required to be
communicated along with the enquiry report to the delinquent employee so that he can
send a representation, if he so desires, to the disciplinary authority within a period of one
month from the date of such communication. Accordingly, a dissenting note dated
30.12.10 was sent to her. She submitted her reply on 14.02.11 to the dissenting note.
I have gone through the entire record of the case i.e. Committee report dated
03.10.05, DEO Hisar report dated 04.10.05, fact finding inquiry report dated 07.10.05
and 10 08 07 submitted by Sh. Lalit Siwatch, HCS, Joint Director and Sh. M.L. Kaushik,
HCS, Addl. Director, respectively, charge-sheet under Rule-7 and explanation thereof,
regular Inquiry Officer report dated 15.12.09, Show Cause Notice dated 02.08.10,dissenting note dated 30.12.10 and reply thereof. The main question to be decided in this
case is whether the incumbent fulfills the condition of experience of 2 years as head of
the Institution while applying for the post of Principal in 1996 and whether the said
experience certificate is genuine.
From the perusal of experience certificate dated 14.05.84 pertaining to St. Peter
High School, Hansi (Hisar), the same has been countersigned by Sub-Divisional
Education Officer (SDEO) on 16.07.96 i.e. after a lapse of more the 12 years and in the
experience certificate it is clearly mentioned that the school is recognized whereas as per
DEO report dated 04.10.05 that during the period from 05.10.81 to 30.09.83 the school
was upto middle standard only and Smt. Usha Rani has never worked in the said
institution in any capacity and has concluded that the experience certificate was fake
and bogus. This view has been confirmed by a 6-Member Committee constituted by the
then Joint Director (Administration). Denial of issuance of the said experience certificate
by Sh. P.L. Ahuja, the then Principal, St. Peter Sr. Sec. School, Hansi (Hisar) duly
supported by Affidavit before the said Committee, further endorse the said version. The
finding of inquiry conducted by Sh. M.L. Kaushik as enunciated above clearly establish
that the school was not recognized at all during the relevant period and the delinquent
official has not worked in the said institution at all in any capacity. The said incumbent
in her latest explanation dated 14.02.11 herself have admitted that the said institution
was not recognized. It is highly surprising how the regular Inquiry Officer of the level of
Senior IAS (Retd.) has tried to circumvent the patent error in the experience certificate
especially regarding recognized institution. It is beyond doubt that the said institution
was not recognized upto high school level during the relevant period. So far as second
arge is concerned, it stood approved by the regular Inquiry Officer and there is no
dispute regarding this It is specific to mention here that an FIR No. 74 dated 15.02.06
was also got registered in this case and is beyond understanding how Smt. Santosh
Kumari, the then DEO Hisar had given her Consent statement dated 16.05.08 before the
Court in a cancellation report submitted by Police without approval of the competent
authority. Vide order dated 16.05.08 FIR was cancelled and the case was filed. The
observation of the incumbent regarding reviewing the orders is of no consequence as the
matter regarding inflicting final punishment was still pending.
In the light of above, both the charges stood approved against Smt. Usha Rani,
Deputy DEO, Hisar. She has been selected Principal in direct quota on the basis of fake,
bogus and non-genuine experience certificate of St. Peter High School, Hansi (Hisar).Endst. No.Even Dated Panchkula the

In this regard, it is informed that as per Rule 50(3) (ii) of HCS (Leave) Rules, 2016, study leave shall not ordinarily be granted to a Government employee who does not hold a gazetted post under the Government. Rule 56(1)(2) and Rule 54(1) ibid also relate to study leave matters. 3. Till appropriate amendments are made in HCS (Leave) Rules, 2016 to grant study
leave to non gazetted Government employees, henceforth relaxation in Rule 50(3)(ii) ibid shall not
be considered by the Finance Department to avoid additional burden on State Government in
shape of half pay leave/allowances. However, Administrative Department may send those cases
to the Finance Department for consideration of such relaxation in Rule 50 (3) (ii) ibid where
permission for higher study has already been granted at the level of HoD/AD before 09.11.2022.

It is also clarified that prior permission for grant of study leave (on half pay
leave) shall only be considered by the Finance Department and the same may not be
granted at the level of HoD/AD under any circumstances.

हरियाणा सरकार ने हरियाणा सिविल सेवा (कार्यकारी शाखा) और अन्य समवर्गी सेवाओं के पदों के लिए प्रारंभिक परीक्षा के सिविल सेवाएं योग्यता परीक्षा(सीएसएटी पेपर) को संघ लोक सेवा आयोग (यूपीएससी) की तर्ज पर क्वालिफाइंग पेपर बना दिया है । हरियाणा सिविल सेवा (कार्यकारी शाखा) प्रथम संशोधन नियम,2020 हरियाणा लोक सेवा आयोग और संघ लोक सेवा आयोग की परीक्षा संशोधन के अनुसार, अब प्रारंभिक परीक्षा का सिविल सेवाएं योग्यता परीक्षा (प्रश्न पत्र-2) 33 प्रतिशत अंकों के न्यूनतम अर्हता अंक के साथ एक क्वालिफाइंग पेपर होगा और प्रारंभिक परीक्षा का परिणाम केवल पेपर-1 (सामान्य अध्ययन) के अंकों पर आधारित होगा, बशर्ते कि उम्मीदवार ने सिविल सेवाएं योग्यता परीक्षा (पेपर-2) पास कर लिया हो।

The HCS (Ex. Br.) & Other Allied Services Preliminary Examination – 2011was conducted by the Haryana Public Service Commission on 25.03.2012 at different stationsin Haryana. The candidates were directed vide Sr. No. 9 of the Instructions printed on thecover page of Question Booklet of each subject that – “Any representation regardingquestion and answer, candidate may give in writing to the Centre Supervisor just after theExam is over. Later on it will not be entertained.” Besides this it was also announced by thecentre Supervisor in each centre that:-“If any candidate finds any type of error / mistake in any Question orany given option / choice in the Answer, he / she is advised to make arepresentation to the Commission and hand over to the Centre Supervisorsoon after the Exam is over. 'o representation / complaint in this regard willbe entertained after declaration of the result”.Representations so received are being segregated. After segregation, all suchrepresentations will be examined and report/comments of the Paper Setters will be sought, ifrequired and the representations will be decided accordingly. It has been observed by the Finance Department that some Government Departments are still implementing the provisions of instructions No.3712-2GS-72/21209 dated 18.2.1972 (copy attached) issued by O/o the Chief Secretary to Govt. Haryana as well as instructions No. 11/33/97-1FR-Il dated 06.10.1999 (copy attached) issued by the Finance Department despite the fact that HCS (Leave) Rules, 2016 has already been made applicable with effect from 19.07.2016 and all the instructions, issued by the Government from time to time, have, been incorporated in new Haryana Civil Services Rules notified by the Finance Department.

और 22.11.2022 ऊपर उल्लिखित विषय के संबंध में। 2. इस संबंध में निर्देश क्रमांक 11/112/2022- 3FR/2338 दिनांक 09.11.2022 द्वारा निम्नलिखित दिशानिर्देश जारी किये गये:-
पैरा 2 (1) जहां अध्ययन अवकाश की आवश्यकता नहीं है:
ए) ऑनलाइन/निजी/पत्राचार/दूरस्थ माध्यम/शाम की कक्षाओं के माध्यम से सार्वजनिक हित में तकनीकी या वैज्ञानिक अध्ययन सहित उच्च अध्ययन/पाठ्यक्रम/प्रशिक्षण प्राप्त करने के मामलों के लिए, जहां कार्यालय समय के दौरान शारीरिक रूप से कक्षा में उपस्थित होने की कोई आवश्यकता नहीं है, वह कर सकता है। विभागाध्यक्ष (ग्रुप-सी और ग्रुप-डी कर्मचारियों के मामले में) और प्रशासनिक विभाग (ग्रुप-बी अधिकारियों के मामले में) द्वारा उच्च अध्ययन करने की अनुमति इस शर्त के अधीन दी जाएगी कि आधिकारिक कार्य में कोई बाधा न आए। परिस्थितियाँ। अधिकारी/कर्मचारी से अपेक्षा की जाएगी कि वह अपने कर्तव्यों और सौंपे गए कार्य पर ध्यान दे। ऐसी अनुमति देने के बाद, एचसीएस (छुट्टी) नियम, 2016 में निर्दिष्ट अनुसार सक्षम प्राधिकारी द्वारा परीक्षा की तैयारी या उपस्थित होने के लिए आकस्मिक छुट्टी (अध्ययन छुट्टी के अलावा) सहित आवेदित छुट्टी दी जा सकती है।
वित्त विभाग में प्राप्त प्रश्न के संदर्भ में, यह स्पष्ट किया जाता है कि उन मामलों में जो उपरोक्त दिशानिर्देशों के अंतर्गत आते हैं, ऐसी अनुमति नियमित आधार पर तीन साल की सेवा की शर्त की पूर्ति के अधीन सक्षम प्राधिकारी द्वारा दी जाएगी।

Para 2 (1) Where study leave is not required:
a) For cases for pursuing higher studies/course/training including technical or scientific studies in public interest through online/private/ correspondence/ distance mode/evening classes, where there is no need to attend class physically during office hours, he/she may be granted permission to pursue higher studies by the Head of Department (in case of Group-C and Group-D employees) and by Administrative Department (in case of Group-B officers) subject to the condition that official work does not suffer under any circumstances. The official/officer shall be expected to attend to his/her duties and work assigned. After granting such permission, applied leave including casual leave (other than study leave) may be granted for preparation or appearing for examination by the competent authority as specified in HCS (Leave) Rules, 2016.

With reference to query received in the Finance Department, it is hereby clarified that in those cases which are covered under aforesaid guidelines, such permission shall be granted by the competent authority subject to fulfilment of condition of three years' service on regular basis.
