संदर्भ एफडी के पूर्व निर्देश क्रमांक 11/112/2022-3FR/2338 दिनांक 09.11.2022

और 22.11.2022 ऊपर उल्लिखित विषय के संबंध में। 2. इस संबंध में निर्देश क्रमांक 11/112/2022- 3FR/2338 दिनांक 09.11.2022 द्वारा निम्नलिखित दिशानिर्देश जारी किये गये:-

पैरा 2 (1) जहां अध्ययन अवकाश की आवश्यकता नहीं है:

ए) ऑनलाइन/निजी/पत्राचार/दूरस्थ माध्यम/शाम की कक्षाओं के माध्यम से सार्वजनिक हित में तकनीकी या वैज्ञानिक अध्ययन सहित उच्च अध्ययन/पाठ्यक्रम/प्रशिक्षण प्राप्त करने के मामलों के लिए, जहां कार्यालय समय के दौरान शारीरिक रूप से कक्षा में उपस्थित होने की कोई आवश्यकता नहीं है, वह कर सकता है। विभागाध्यक्ष (ग्रुप-सी और ग्रुप-डी कर्मचारियों के मामले में) और प्रशासनिक विभाग (ग्रुप-बी अधिकारियों के मामले में) द्वारा उच्च अध्ययन करने की अनुमति इस शर्त के अधीन दी जाएगी कि आधिकारिक कार्य में कोई बाधा न आए। परिस्थितियाँ। अधिकारी/कर्मचारी से अपेक्षा की जाएगी कि वह अपने कर्तव्यों और सौंपे गए कार्य पर ध्यान दे। ऐसी अनुमति देने के बाद, एचसीएस (छुट्टी) नियम, 2016 में निर्दिष्ट अनुसार सक्षम प्राधिकारी द्वारा परीक्षा की तैयारी या उपस्थित होने के लिए आकस्मिक छुट्टी (अध्ययन छुट्टी के अलावा) सहित आवेदित छुट्टी दी जा सकती है।

वित्त विभाग में प्राप्त प्रश्न के संदर्भ में, यह स्पष्ट किया जाता है कि उन मामलों में जो उपरोक्त दिशानिर्देशों के अंतर्गत आते हैं, ऐसी अनुमति नियमित आधार पर तीन साल की सेवा की शर्त की पूर्ति के अधीन सक्षम प्राधिकारी द्वारा दी जाएगी।

and 22.11.2022 regarding the subject noted above. 2. In this regard, following guidelines were issued vide instructions No.11/112/2022- 3FR/2338 dated 09.11.2022:-

Para 2 (1) Where study leave is not required:

a) For cases for pursuing higher studies/course/training including technical or scientific studies in public interest through online/private/ correspondence/ distance mode/evening classes, where there is no need to attend class physically during office hours, he/she may be granted permission to pursue higher studies by the Head of Department (in case of Group-C and Group-D employees) and by Administrative Department (in case of Group-B officers) subject to the condition that official work does not suffer under any circumstances. The official/officer shall be expected to attend to his/her duties and work assigned. After granting such permission, applied leave including casual leave (other than study leave) may be granted for preparation or appearing for examination by the competent authority as specified in HCS (Leave) Rules, 2016.

With reference to query received in the Finance Department, it is hereby clarified that in those cases which are covered under aforesaid guidelines, such permission shall be granted by the competent authority subject to fulfilment of condition of three years' service on regular basis.

2. In this regard, it is informed that as per Rule 50(3) (ii) of HCS (Leave) Rules, 2016, study leave shall not ordinarily be granted to a Government employee who does not hold a gazetted post under the Government. Rule 56(1)(2) and Rule 54(1) ibid also relate to study leave matters. 3. Till appropriate amendments are made in HCS (Leave) Rules, 2016 to grant study

leave to non gazetted Government employees, henceforth relaxation in Rule 50(3)(ii) ibid shall not

be considered by the Finance Department to avoid additional burden on State Government in

shape of half pay leave/allowances. However, Administrative Department may send those cases

to the Finance Department for consideration of such relaxation in Rule 50 (3) (ii) ibid where

permission for higher study has already been granted at the level of HoD/AD before 09.11.2022.

It is also clarified that prior permission for grant of study leave (on half pay

leave) shall only be considered by the Finance Department and the same may not be

granted at the level of HoD/AD under any circumstances.

GPF deduction under tax conditionally

वित्त विभाग द्वारा जारी हिदायतों अनुसार अब किसी भी कर्मचारी के एक वित्त वर्ष में PF(GPF) में पांच लाख से ज्यादा जमा नहीं होंगे । अगर किसी के पहले ही पांच लाख जमा हो चुके हैं तो चालू वित्त वर्ष की शेष अवधि में अब उस कर्मचारी की कोई कटौती नहीं की जाएगी व उक्त कर्मचारी को 8 फीसदी कटौती की अनिवार्य कटौती में Relaxation दी जाएगी ।

पांच लाख से ऊपर राशि का ब्याज एक टैक्सेबल इनकम है जो चालू वर्ष और आगामी वर्षों में भी टैक्सेबल ही रहेगा ।

Ceiling of Rs.Five Lakh on subscription to General Provident Fund in a Financial

Year-instructions regarding.

Sir/Madam,

I have been directed to invite your attention to the Gazette Notification of Govt. of India, Ministry of Personnel, Public Grievances and Pensions (Deptt. of Pension & Pensioners' Welfare) bearing No. G.S.R.36, dated 15.6.2022 vide which an anrual ceiling of Rs. Five Lakh only (including monthly subscriptions and arrears of subscriptions, if any) has been fixed for the total amount of subscription in a financial year on General Providen: Fund for Certral Government employees and the General Provident Fund (Central Services) Rules, 1960 have been accordingly amended. This ceiling has been fixed/GPF Rules have been so amended follow ng an amendment dated 31.8.2021 having been made by the Govt. of India in the Income Tax Rules, 1962 vide which annual ceiling of Rs. Five. Lakh ony (monthly subscription and arrears of subscription, if any) has been fixed for total subscription on GPF and other recognized Providert Funcs for earning non-taxable interest. The purpose of this amendment is that the interest accrued on the subscription beyond Rs. Five Lakh only shall be chargeable to Income Tax

In view of the above, the ex sting Rule 22 of HCS (GPF) Rules, 2016 which deals with the "ate/ceiling of subscription is recuired to be amended accordingly for which requisite process has already been undertaken. Since, the amendment as such shall take its cwn time in due course and the current financial year 2022-23 is rearing its end, therefore, in order to comply with the inherent provision in the remaining part of current financial year 2022-23, it has been decided as under:-

There may be chances that some employees might have crossed the proposed ceiling of

Rs. Five Lakh only during currert financial year. In these cases, no further subscription

to their respective GPFS shall be made by the respective DDOS in the remaining pay months of current financial year 2022-23. In such cases, the minimum subscription of 8% of basic pay, as per Rule 22 ibid snall be deemed to have been relaxed. In the cases of all other employees, it will be ensured by the respective DDOS that their total annual subscription should not exceed Rs. Five Lakh in the current financial year

किसी की नहीं कटेगी या रूकेगी ACP।सभी को सभी तीनो ACP मिलेगी....आधार रहेगा कार्यात्मक पदानुक्रम (Functional hierarchy)

कल 25 फरवरी 2022 को हरियाणा विद्यालय अध्यापक संघ का प्रतिनिधि मंडल श्री धर्मेन्द्र ढांडा की अध्यक्षता में  पूर्वनिर्धारित (8/2/22 को शिक्षामंत्री की बैठक में निर्धारित) बैठक में शिक्षा सदन पंचकूला में अकाट्य सबूतों व तर्को के साथ अपनी बात रखी।सभी अधिकारियों ने अध्यापक संघ के पक्ष को सही माना।

        अतिरिक्त निदेशक श्री मुकेश जी HCS की अध्यक्षता में  निदेशालय के chief account officer श्री दुहन जी, Account Officer व पंचकूला और अंबाला जिलो के अनुभाग अधिकारी व ACP मामलो की सिनियर सुपरिटेंडेंट श्रीमती सलोचना के साथ प्रतिनिधि मंडल ने अपना पक्ष रखा व मनवाया।प्रतिनिधि मंडल में राज्य प्रधान धर्मेंद्र ढांडा, महासचिव प्रभु सिंह,मुख्य सलाहकार सी. एन.भारती,उपमहासचिव कृष्ण नैन,राज्य उपप्रधान बहन मंजू गुर्जर,राज्य आडिटर विजयपाल व यमुनानगर के जिला प्रधान संजय कुमार शामिल रहे।

        01/01/1996 से ए सी पी(इससे पहले अन्य नामों से) शुरू होने के इतिहास से बात शुरू की गई।उसके बाद 12/5/1998 के प्राथमिक के व सैकेंडरी के रूल अक्षरशः पढ़े व समझे गये। इन्ही के आधार पर वर्तमान में विभाग के बने 11/4/2012 के रूल अक्षरशः स्वयं अतिरिक्त निदेशक महोदय ने पढ़े। इन रूलो पर अध्यापक संघ ने अपने तर्को व सबूतो के साथ अपना पक्ष रखा। जिससे  श्री मुकेश जी, चीफ अकाउंट आफिसर, एकांउट ऑफिसर व उपस्थित दोनों अनुभाग अधिकारी संतुष्ट व सहमत थे। एसीपी मामलो के सुपरिटेंडेंट को कुछ जाने-अनजाने जो भ्रम था, जिसे अधिकारियों ने अध्यापक संघ की समझ से सहमत करवाया व भविष्य में किसी भी शिक्षक का अनावश्यक रूप से एसीपी न रोकने के लिए सभी को हिदायतें भी जारी करने पर सहमति बनी।

सहमति पक्ष के बिंदु

  🍇11/4/2012 से पहले की ड्यू सभी एसीपी पर पुराने ही नियम लागु रहेगें।

🍇किसी भी केटेगरी के शिक्षक के लिए कोई पदोन्नति का उच्च पद ही नही है (C&V) या उसके कार्यात्मक पदानुक्रम(Function hierarchy) में पदोन्नति की योग्यता रखता है तो उन्हे सभी तीनो एसीपी समयबद्ध 8-16-24 वर्ष की सेवा पूरी करते ही मिलेंगे।

🍇5 साल का अनुभव पूरा कर चुके सभी TGT को विभाग 3 सप्ताह की (एसीपी के लिए निर्धारित योग्यता) ट्रैंनिंग करवाएगा,यह विभाग का काम है,संबंधित शिक्षक का नहीं।

🍇अगर कोई शिक्षक अपनी कार्यात्मक पदानुक्रम (jbt से H.T की पदोन्नति.. TGT से ESHM/H.M.की पदोन्नति,PGT से H.M/Principal की पदोन्नति) यानि Functional hierarchy के पदो की पदोन्नति को Forgo करता है तो,उसकी अंतिम एसीपी कटेगी, परन्तु यदि वह उच्च योग्यता आधारित पदोन्नति को Forgo करता है तो उसकी कोई एसीपी नहीं कटेगी।

🍇 सभी केटेगरी में (2012 के बाद लगने वाली) तीनों एसीपी के लिए 11/4/2012 के सर्विस रूल की भर्ती की शर्तो को ही पूरा करना मात्र शर्त लागू होती हैं।

 1)जेबीटीः भर्ती के लिए बाहरवीं ,Ded,Deled में 50% की शर्त हैं।यही भर्ती वाली योग्यता ही H.T. की पदोन्नति की योग्यता हैं। यही उसकी कार्यात्मक पदानुक्रम के तहत किसी भी अन्य शर्त को देखने की जरूर ही नहीं हैं।अगर कोई जेबीटी उच्च योग्यता प्राप्त नहीं करता तो,उसे भी तीनो एसीपी समयबद्ध 8-16-24 साल पर मिलने ही हैं। तब उच्च योग्यता वालो के लिए सजा क्यों हो।योग्यता आधारित पदोन्नति तो पदोन्नति दूसरी व तीसरी अतिरिक्त शर्तो को पुरा करना है, जिनका एसीपी से कोई लेना देना ही नहीं हैं। इसलिए सभी जेबीटी को सभी तीनों एसीपी देने बनते है।उनकी मास्टर पद के लिए निर्धारित योग्यता की कोई जरूरत ही नहीं है,सिर्फ Functional  hierarchy के आधार पर ही देय बनते हैं।(बाहरवीं में 50% की एकमात्र शर्त पूरी करनीं हैं।)

2)सी एण्ड वीः C & V की Function hierarchy में पदोन्नति का कोई पद ही नहीं है।इसलिए इसके लिए तो एसीपी में योग्यता या अंकों का कुछ देखा ही नहीं जाना हैं। सभी ड्राईंग व पीटीआई को तीनों ही एसीपी बिना किसी भी शर्त के सिर्फ समयबद्ध 8-16-24 वर्ष की सेवाअवधि पूर्ण करते ही मिलने तय है।कोई नियम आड़े नहीं आ रहा हैं। इस पर भी सभी सहमत थे,कि जब एसीपी के लिए आधार ही Function hierarchy है,ओर उसमें समयबद्ध एसीपी है,तो किसी भी उच्च पर पदोन्नति की योग्यता एसीपी के मामले में देखना, एसीपी के नियमों के विरूद्ध हैं। यदि कोई टीजीटी की योग्यता मांगता है,तो उसकी शिकायत निदेशालय में की जाए।

3)टीजीटीःटीजीटी की कार्यात्मक पदानुक्रम (Functional hierarchy)*की पदोन्नति ESHM/high.s.H.M की बनती है। इस पद की कार्यात्मक पदानुक्रम(Function hierarchy) में ये दो ही पद है,जिनमें किसी अन्य उच्च योग्यता या प्रतिशत की शर्त ही नहीं हैं। इसलिए इनको भी तीनो एसीपी समयबद्ध 8-16-24 वर्ष की सेवापूर्ण करते ही बिना PGT की योग्यता के मिलेगे।(पुराने टीजीटी के लिए स्नात्तक में  व बीएड़ की 45% की शर्त में कोई अपवाद स्वरूप रह सकता हैं।)

4)PGT: पीजीटी की Function hierarchy में प्रिंसिपल, बीईओ के लिए कोई अतिरिक्त योग्यता की जरूरत नहीं होती,इसलिए उसे भी (जिनकी bed नहीं है,उनके लिए सहमती नहीं बनी हैं।,इस पर हमारा आंदोलन जारी रहेगा)।

         साथियों ध्यान रहे कि हमारी एसीपी पर इतने विशेषज्ञों व उच्च अधिकारियों के साथ बैठक में,सहमती है।वे अध्यापक संघ के तर्क व सबूतो,जो स्वयं नियम ही है सहमत है।एसीपी रोकना नियमों का न होना,या उसकी समझ न होने का मामला नहीं हैं।उन्हे बार बार वापस भेजना। एक ही एतराज बार बार लगाना,एतराज को स्पष्ट न करना... यह सिर्फ ओर सिर्फ भ्रष्टाचार का मामला हैं। इसके लिए हमें संबंधित कर्मचारियों/अधिकारियों को समझाना होगा,ना समझे तो आंदोलन का दबाव व उच्च अधिकारियों को नाम व सबूतो के साथ शिकायत ही बनता

उच्च शिक्षा प्राप्त करने के लिए 5 वर्ष की नियमित सेवा जरूरी है. सरकारी नौकरी में आने से पहले जो कोर्स चला हुआ है, उसके लिए अनुमति लेने की आवश्यकता नहीं हैं. उच्च शिक्षा प्राप्त करने के लिए आप MIS पर आवेदन कर सकते है.)

It has been observed by the Finance Department that some Government Departments are still implementing the provisions of instructions No.3712-2GS-72/21209 dated 18.2.1972 (copy attached) issued by O/o the Chief Secretary to Govt. Haryana as well as instructions No. 11/33/97-1FR-Il dated 06.10.1999 (copy attached) issued by the Finance Department despite the fact that HCS (Leave) Rules, 2016 has already been made applicable with effect from 19.07.2016 and all the instructions, issued by the Government from time to time, have, been incorporated in new Haryana Civil Services Rules notified by the Finance Department.

*🔽1) Exgratia grant of Rs One lakh to be paid within one month.

*🔽2) GIS insurance Rs 15/30/60/120 thousand and his /her deposits.

*🔽3) Gratuity equal to last emoluments ( B pay + D A) in case death occurred :-

 *A)  before 1 Year service = 2 months

 *B) 1 year or < 5 year = 6 months

 *C)  5 Year or < 24 Year = 12 months

 *D)  > 24years service = normal rate as on retirement.

*🔽4) If employee has salary account than in case of normal death insurance of Rs 2 lakh and in case of accidental death Rs 30 lakh.

*Accidental death of family member Rs  5 lakh by Bank but the claim should be put within 90 days.

*🔽5) GPF to his / her dependent.

*🔽6) Leave encasement equal to in record but Max 300 days.

*🔽7)  Pension at enhanced rate up to 10 years after the date of death ( 50% ) and thereafter 30%.

*🔽8) HRA equal to last drawn amount up to one year after death under rule  16 of HCS ( allowances)  Rules 2016 .

*🔽9)  Compassionate M. F.  A.  :

*A)  for 15 years if death before 35 year of age.*

*B)  for 12 years or up-to date of superannuation if death on age of  35 years or before 48 years of age.

*C)  for 7 years or up-to date of superannuation if death on or after age of 48 years.*

*▶️Note :- Date of superannuation is 60 years for D group and 58 years for others.

*Compassionate appointment

*🛑In addition of above all pending amounts will also be paid by DDO / department to his / her legal heirs

*🛑Compassionate appointment benefit can be availed only if the employee has minimum 5 years of regular service and has has not attained the age of  52 years.

*🛑Loans /  advances and interest thereon are waived off in case of death or missing C and D group employees as below :-

*A)  marriage, cycle, wheat and festive advances.

*B) First HBA and computer advance if not more than one surviving family members are in service .

*C)  Scooter / Motor cycle advance if death occurs due to accident.

*🛑The following benefits are also applicable in case of death or missing of a govt employee during FMA :-

*A)  Fixed medical allowance and reimbursement for medical expenses.

*B) Children Education allowance upto class 10+2 for 2 eldest children, this allowance is given upto his superannuation age either he receives MFA or not. After 10+2 tuition fee and laboratory fee are also reimbursed up to degree level. This benefit is given only if the spouse of deceased is not in govt service.l

You are, therefore, asked to attend the said video conference. If the equipment in your office is not working properly, then visit the nearest DEO office to attend this meeting

Moreover, the representative from District Units of Teacher Unions (PGTS. TGTS, PRTS etc.) may also be invited at your own level and their presence in the said meeting may

be ensured.

It may be given top priority.

HCS new paper style and selection process

यूपीएससी  की तर्ज़ पर HCS की परीक्षा में बड़ा बदलाव

 हरियाणा सरकार ने हरियाणा सिविल सेवा (कार्यकारी शाखा) और अन्य समवर्गी सेवाओं के पदों के लिए प्रारंभिक परीक्षा के सिविल सेवाएं योग्यता परीक्षा(सीएसएटी पेपर) को संघ लोक सेवा आयोग (यूपीएससी) की तर्ज पर क्वालिफाइंग पेपर बना दिया है । हरियाणा सिविल सेवा (कार्यकारी शाखा) प्रथम संशोधन नियम,2020 हरियाणा लोक सेवा आयोग और संघ लोक सेवा आयोग की परीक्षा संशोधन के अनुसार, अब प्रारंभिक परीक्षा का सिविल सेवाएं योग्यता परीक्षा (प्रश्न पत्र-2) 33 प्रतिशत अंकों के न्यूनतम अर्हता अंक के साथ एक क्वालिफाइंग पेपर होगा और प्रारंभिक परीक्षा का परिणाम केवल पेपर-1 (सामान्य अध्ययन) के अंकों पर आधारित होगा, बशर्ते कि उम्मीदवार ने सिविल सेवाएं योग्यता परीक्षा (पेपर-2) पास कर लिया हो।

Rule शिक्षा विभाग नॉन वेकेशन विभाग है.HCS(leave) Rules,2016 के रूल 35 के अनुसार 20 वर्ष की सेवा अवधि पूरे कर चुके कर्मचारी को वेकेशन पीरियड के दौरान डियूटी का 12 वां भाग ही अर्जित अवकाश देय हैं।
